Q. Can I get a general Letter of Compliance?
A. No – A Letter of Compliance can only be issued for a specific public body, contractor, or contract.
Q. Can I request a Letter of Compliance for Trade Unions, the Labour Court or Monitoring Bodies?
A. No – CWPS does not issue any Letters of Compliance for the above.
Q. How do I request a Letter of Compliance?
A. You can contact the Compliance team to request a Letter of Compliance by email (loc@cwps.ie), by fax (01-507-7425) or by phone (01-497-7663). In order to speed up the process please remember to quote your Employer ID and the details of the public body/contract/contractor that has requested the Letter of Compliance.
Q. What do I need to do to get a Letter of Compliance?
A. Firstly, you must have all pension contributions for all your registered employees paid up to date in accordance with the Pension Act 1990 and CWPS Trust Deed and Rules. This means that the previous month’s pension contributions must be paid by the 21st day of the following month.
Secondly, you must send the Compliance team evidence of compliance for the Tax Year previous to the one in which the Letter of Compliance is required. This evidence can be in the form of a specifically worded letter from your accountant/auditor or a full copy of your P35 returns.
Q. I am a newly registered employer with CWPS, how can I get a Letter of Compliance?
A. As a newly registered employer with CWPS you must pay 13 weeks pension contributions in advance for all your employees covered by the REA, from the date you registered them in the scheme. This payment must be made by electronic banking or bank draft.
Q. Can I get a Letter of Compliance if I do not have any employees?
A. No. We cannot issue a Letter of Compliance if you do not have any employees registered in the scheme at the time of request.
Q. Can I get a Letter of Compliance for previous years?
A. No. We cannot issue Letters of Compliance for previous years as all Letters of Compliance issued are dated at the time of issue and are valid for a 1 month period only.
Q. How will I receive my Letter of Compliance?
A. We can issue Letters of Compliance by e-mail if an email address has been received by the Compliance team, or by post. The e-mailed version of the Letter of Compliance is a PDF version which cannot be printed off however it can be forwarded to the relevant person(s) requesting it. The Letter of Compliance issued by post will contain a hologram and for this reason it cannot be copied. Under no circumstances will Letters of Compliance be faxed to employers.
Q. How long is the Letter of Compliance valid for?
A. Letters of Compliance are valid for a 1 month period from the date of issue. The date of issue is stated on the Letter of Compliance.
Q. How long does it take to get a Letter of Compliance?
A. The official turnaround time is 3 working days from date of request to date of issue, however, the Compliance Team aims to issue Letters of Compliance as soon as possible to employers who meet the required criteria.
We also make every effort to contact employers who do not meet the required criteria within 3 working days to resolve any outstanding issues. Please contact the Compliance team as early as possible with your request so we can deal with it in a timely fashion.
